iSV Products & A.P.D.L. Applications End User Licence Agreement

All of the iSV Products applications that you can download from this website are copyright 3QD Developments Ltd and/or Aaron Timbrell. You do not have to pay to download or use this iSV Products application but you may choose to make a small optional donation to help cover running costs after your download has completed.

Despite being provided free of charge this iSV Products application is not 'Public Domain', 'Open Source' or 'Freeware'. Use of this iSV Products application is subject to the terms of the licence below.

Definitions

The following expressions have the meaning given below:

'iSV Products application' means any computer software that has been supplied by iSV Products or by A.P.D.L. under the iSV Products banner and is now offered for download by 3QD Developments Ltd.

'3QD Developments Ltd' means the company 3QD Developments Ltd who hold copyright over the iSV Products applications.

'The Estate of David Holden' means those who have been appointed to look after the interests of the late David Holden.

Licence Grant, Conditions and Restrictions

3QD Developments Ltd grants you a free of charge, non-exclusive, non-transferable, royalty free personal licence to download this iSV Products application and to install said application on any of your computers that are running RISC OS, either directly or via emulation. You may take backups of this iSV Products application for your own use. Please note that free of charge iSV Products applications are licenced for personal use only. Commercial use will require a different licence for which a charge may be made.

You must ensure that the copyright, trademark and other protective notices contained in the iSV Products application are maintained and not altered or removed and that all such notices are reproduced and included in any copy of the iSV Products application.

Except as authorised above or expressly permitted by statute you may not: copy all or part of the iSV Products application; incorporate all (or any of) the iSV Products application into other programs developed by (or on behalf of) you and/or used by you; reverse engineer, decompile or disassemble the iSV Products application.

Distribution

You may not rent, lease, gift, loan, sell, distribute or transfer possession of any of the iSV Products applications in whole or in part without prior written permission from 3QD Developments Ltd. Commercial distribution of this or any other iSV Products application is strictly forbidden.

If you are asked for a copy of this (or any other iSV Products) application you should direct the person concerned to this website where they can download their own copy of the iSV Products application(s).

Termination

This licence is effective until terminated. This licence will terminate automatically without notice if you fail to comply with any of its provisions. You may voluntarily terminate this licence yourself. Upon termination you must destroy the Software (and all copies thereof) and forfeit all rights under this licence.

Warranty

This iSV Products application is supplied 'as is' and 3QD Developments Ltd/The Estate of David Holden expressly exclude all warranties, express or implied including (but not limited to) warranties of satisfactory quality, merchantability, fitness for purpose and non-infringement (save to the extent that the same are not capable of exclusion at law). In no circumstances will 3QD Developments Ltd be liable for any direct, indirect, consequential, or incidental damage (including loss of profits, business interruption and loss of data) arising out of the use or the inability to use this iSV Products application.

Technical Support

This iSV Products application is supplied 'as is' and by accepting this licence you are confirming that you have the skills necessary to download, install and use this product. The iSV Products application will include the original instructions and optionally any on screen manual. Please note that 3QD Developments Ltd will not be able to provide you with technical support via phone, letter or e-mail for this iSV Products application.

General

The above terms and conditions supersede any prior agreement, oral or written, between you and 3QD Developments Ltd relating to the iSV Products applications. This End User Licence will be governed by the laws of England.
